These Terms of Service ("Terms") apply to your use of the CUBBLI website and online store and to any products you purchase from us.

By using our website or placing an order, you agree to these Terms. If you do not agree, please do not use our website or place an order.

In these Terms, "CUBBLI", "we", "us" and "our" means CUBBLI, and "you" and "your" means the person using our website or purchasing our products.

These Terms should be read together with our Privacy Policy and Refund & Returns Policy.

Using Our Website

You must:

provide accurate information when placing an order;
use the website only for lawful purposes;
not interfere with, disrupt or attempt to gain unauthorised access to our website or systems;
not use our website to commit fraud or infringe another person's rights; and
not copy, reproduce, modify or commercially exploit our website or its content without our written permission.

We may update, modify, suspend or discontinue any part of our website or Services at any time. We do not guarantee that our website will always be available, uninterrupted or error-free.

Products and Product Information

CUBBLI creates keepsake and memory storage products designed to help families preserve childhood memories and milestones.

We make reasonable efforts to ensure that product descriptions, photographs, dimensions, colours and other information on our website are accurate. However:

colours may vary depending on your screen or device;
personalised products may contain minor variations;
handmade, printed, embossed or finished components may have minor differences; and
product specifications, packaging and availability may change from time to time.

All products are subject to availability. We may discontinue or modify products at any time.

Orders and Payment

When you place an order, you agree to provide complete and accurate information, including your name, contact details, shipping address and personalisation details.

Full payment is required at checkout.

Submitting an order constitutes an offer to purchase the products selected. Your order is accepted when payment has been successfully processed and we send you confirmation that your order is being processed.

We may cancel an order where, for example:

a product is unavailable;
there is a genuine pricing or listing error;
we reasonably suspect fraudulent or unauthorised activity; or
we are unable to fulfil the order.

If we cancel an order after payment has been received, we will provide a refund of the amount paid.

Payments are processed through Shopify and/or third-party payment providers. We do not store full payment card details on our own systems.

Pricing

All prices are displayed in Australian Dollars (AUD).

Unless otherwise stated, applicable GST is included in prices displayed to Australian customers.

Shipping costs are shown at checkout and may be waived where our advertised free-shipping threshold applies.

Prices may change at any time before you place an order.

If a genuine pricing error affects an order you have placed, we will contact you as soon as reasonably practicable. You may choose to proceed at the correct price or cancel the affected order for a full refund.

Personalised Products

Some CUBBLI products are personalised using information submitted by you, including names, dates, messages or other customisation details.

Please carefully check all personalisation information before completing your order.

You are responsible for ensuring that names, spelling, dates and other information supplied to us are accurate.

If you provide incorrect information and the product is produced in accordance with the information you supplied, CUBBLI is not responsible for the resulting error.

If you notice an error in your personalisation after placing an order, contact us as soon as possible. We will try to assist where the order has not yet entered production, but changes cannot be guaranteed once processing or production has commenced.

Cancellation of personalised orders

Because personalised products are made specifically for you, change-of-mind cancellations are generally not available once an order has been processed or production has commenced.

This does not affect any rights or remedies you may have under the Australian Consumer Law.

Pre-Orders

Where CUBBLI offers a product for pre-order, the applicable product page will specify the expected availability or dispatch timeframe. Pre-orders require payment at the time of purchase unless otherwise stated.

You are responsible for providing accurate and current contact, billing and delivery information.We will notify you when your pre-order is ready for dispatch. If there is a significant delay, we will contact you using the details provided with your order.

If a pre-order cannot be fulfilled, we will notify you and provide an appropriate remedy, including a refund where required by law.

Shipping and Delivery

CUBBLI ships within Australia using Australia Post. Processing and delivery times are estimates and may vary during peak periods or due to circumstances outside our control.

Once your order has been dispatched, you will receive tracking information by email.

Lost, Damaged or Delayed Parcels

For delays after dispatch, please contact Australia Post using your tracking information.

If your parcel is lost or damaged, please contact CUBBLI and, where required, provide the relevant tracking or investigation details.

Returns & Refunds

Depending on the circumstances, you may be entitled to a repair, replacement, refund or other remedy where a product:

is faulty or defective;
is unsafe
does not meet applicable consumer guarantees; or
otherwise fails to comply with the ACL.

We do not generally accept change-of-mind returns for personalised products because they have been made specifically for you.Our team is available to assist with product selection.

Intellectual Property

All intellectual property relating to CUBBLI, including our:

name and branding;
logos and trademarks;
product designs;
photographs and graphics;
website content;
written content;
packaging and artwork; and
other original materials

is owned by or licensed to CUBBLI unless otherwise stated.

You must not copy, reproduce, modify, distribute or commercially exploit our intellectual property without our written permission, except where permitted by law.

Customer Content

If you voluntarily provide CUBBLI with photographs, reviews, testimonials or other content, you confirm that you have the necessary rights and permissions to provide that content. Our use of personal information is governed by our Privacy Policy.

Where you provide customer content for us to use in connection with CUBBLI, we will only use that content for the purposes for which you have given us permission or as otherwise permitted by law.

We may remove or decline to publish content that is unlawful, misleading, offensive or otherwise inappropriate.

Liability

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot legally be excluded under Australian law, including the Australian Consumer Law.

To the maximum extent permitted by law, CUBBLI is not liable for loss arising from:

your misuse of a product;
your failure to follow reasonable care or usage instructions;
incorrect information supplied by you for personalisation or delivery; or
your unlawful or unauthorised use of our website.

To the maximum extent permitted by law, CUBBLI is not liable for indirect or consequential loss, including loss of profits, business opportunities or data, except where such liability cannot legally be excluded.

Nothing in these Terms limits our liability for matters that cannot legally be limited or excluded.

Third-Party Services

Our website uses third-party services, including Shopify, payment providers, delivery providers, analytics services and other technology providers.Third-party services may be subject to their own terms and policies.

Promotions

From time to time, CUBBLI may offer promotional codes, discounts, giveaways or other promotions.

Each promotion may be subject to additional terms specified at the time of the promotion.Unless otherwise stated, promotions cannot be combined, exchanged for cash or applied retrospectively to previous orders.

We reserve the right to correct errors or withdraw a promotion where reasonably necessary, subject to applicable law.

We may update these Terms from time to time to reflect changes to our business, products, Services or legal requirements.

The updated Terms will be published on our website with a revised "Last updated" date.The Terms that apply to an order are those in effect when the order is placed, unless otherwise required by law or agreed with you.
